Creditor of an unclaimed estate?

As a creditor in an unclaimed estate, you do not necessarily have to be left empty-handed. But what can you do to get your invoice paid? According to Section 4:204 of the Dutch Civil Code, the Court may appoint a liquidator at your request.

For example, an estate is unclaimed if;

  • not all heirs are known or respond;
  • all known heirs have refused the estate;
  • the estate is not administered by an executor (named in a will).

Liquidator appointment procedure
